LIMITED WARRANTY

Hitachi America, Ltd. (“Hitachi”) stands behind the quality of its products and warrants to original end users in the United States only that its plasma display products will be free from defects in material and workmanship for two years from the date of original purchase from an authorized Hitachi dealer. This warranty extends to the original end user only and cannot be transferred to another individual or company.

When Warranty is Void

This warranty shall terminate and Hitachi shall have no obligation pursuant to it if:

(1) your Hitachi product has been modified or repaired in a manner not previously authorized by Hitachi in writing; (2) the identification markings on your Hitachi product have been removed, defaced or altered; (3) your Hitachi product was subjected to accident, abuse, or improper use; (4) your Hitachi product was not installed on a system configured as specified in the user’s manual;  (5) your Hitachi product was subjected to operating conditions more severe than those specified in the user’s manual; or (6) you or other unauthorized persons have opened the plasma display product case.

Exclusion From This Warranty

This limited warranty does not cover damage or malfunction caused by abuse, accident, disaster, misuse, mishandling, mispackaging or shipping, improper installation, unauthorized repair or modification, or failure to follow the manufacturer’s instructions with respect to the proper handling, operation, installation, service and maintenance of the plasma display product. Please note that it is normal for plasma displays to become less bright or to experience increase cell defects over time as phosphors contained in the Plasma Display Panel (PDP) degrade. In addition, if an image on the display screen is shown for an extended period of time, the image may become burned into the phosphors. The Hitachi warranty specifically excludes phosphor decay or burns, and damage to the PDP.

Repairs Under This Warranty

In the unlikely event that your Hitachi plasma display product should prove defective during the warranty period, contact Hitachi PLASMA support at 1-800-499-6398 for a Return Material Authorization (RMA) number. NO RETURNS WILL BE ACCEPTED WITHOUT AN RMA NUMBER. Products returned for service must be securely packaged to prevent damage in the original shipping container or its equivalent.  Product must be returned with shipping charges pre-paid and proof of purchase included in the box. The RMA number must be prominently listed on the exterior of the box. Failure to properly package the plasma display product will void all warranties. Within a reasonable time after receipt of your product properly shipped as described above, Hitachi will either ship to you, at its option, the repaired plasma display product or replace it with a new or reconditioned product of comparable or greater specified functionality. If in Hitachi’s sole opinion no comparable product is available, Hitachi may, at its sole discretion and option, refund the original purchase price.  Hitachi’s entire liability and your exclusive remedy for valid warranty claims shall be as stated above. All replacement parts, PDP or plasma display products become Hitachi’s property. All repaired or replaced product shall be warranted for the remainder of the original one year warranty period or, if longer, for three months from the shipment by Hitachi of the repaired or replacement product to you.

NEVER OPEN THE PLASMA DISPLAY CABINET. If the plasma display product is not working properly call the Hitachi plasma service center. By opening the plasma display cabinet, you will expose yourself to high voltage and possible severe electrical shocks and void all warranties.

HITACHI MAKES NO OTHER EXPRESS OR IMPLIED WARRANTY WITH RESPECT TO YOUR HITACHI PRODUCT OTHER THAN THE LIMITED WARRANTY SET FORTH ABOVE. NO HITACHI DEALER, AGENT OR EMPLOYEE IS AUTHORIZED TO MAKE ANY MODIFICATION, EXTENSION OR ADDITION TO THIS WARRANTY.  UNLESS UNENFORCEABLE OR UNLAWFUL UNDER APPLICABLE LAW, HITACHI DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRIGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.  ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON THIS PLASMA DISPLAY PRODUCT IS LIMITED TO THE ONE YEAR DURATION OF THIS WRITTEN WARRANTY. HOWEVER, SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

THE LIABILITY OF HITACHI, IF ANY, FOR DAMAGES RELATING TO ANY ALLEGEDLY DEFECTIVE PRODUCT SHALL UNDER ANY TORT, CONTRACT OR OTHER LEGAL THEORY BE LIMITED TO THE ACTUAL PRICE PAID FOR SUCH PRODUCT AND SHALL IN NO EVENT INCLUDE INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES OF ANY KIND EVEN IF HITACHI IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES.  SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS WHICH VARY STATE TO STATE.
